IMAGE USE LICENSE



PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS SITE. NO RIGHTS ARE GRANTED TO BUYER UNTIL PAYMENT HAS BEEN MADE IN FULL.


THIS IS A LEGAL AGREEMENT BETWEEN YOU (“BUYER”) AND KIMBER HODSON, owner of Kimberhodson.mypixieset.com in regards to all images licensed by Kimber Hodson. Your right to reproduce an image(s) is subject to the terms, conditions, and restrictions set forth in this agreement and is conditioned upon your full payment to Kimber Hodson prior to your reproduction of the image(s). By using this site you agree to these terms.

If you are entering into this Agreement on behalf of your employer, the License granted and the restrictions and limitations on the use of the images set forth below apply to your employer as well as to you as a representative of your employer. Should you cease working for your employer, your employer may continue to use the images under the terms of this Agreement.

Kimber Hodson grants Buyer a non-exclusive, perpetual, non-transferable, personal-use license to download and copy the accompanying image(s) only for any non-commercial use, including but not limited to reprints, enlargements, gifts to family and friends, slideshows, and web pages.


What you may do

Personal use means the Buyer shall only use the image(s) for personal use. This includes:

  • Displaying the image(s) on personal websites and computers.
  • Making image prints for personal use.
  • Sharing images through a personal blog or social media. All images posted on social media require credit towards Kimber Hodson. Buyer shall not copy, download, screen shot, or capture the photographs in any other fashion. Buyer also shall not crop, edit, or add filters to any photographs.
  • Backing up, copying, or archiving the image(s) as is necessary for your own personal use, and only as is necessary for that use. Any copy or archive you make must include the image(s) copyright information.


What you may not do

Buyer may not

  • Resell, relicense, sub-license or redistribute image(s) without express written permission from Photographer.
  • Submit image(s) to contests.
  • Use image(s) in advertising.
  • Use image(s) as a derivative work. Reselling or redistributing such derivative work is prohibited.
  • Use the image(s) in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration.
  • Use image(s) in a pornographic, obscene, illegal, immoral, libelous or defamatory manner.
  • Incorporate image(s) into trademarks, logos, or service marks.
  • Make image(s) available for download.

All rights, license, copyright, title and ownership, and all rights now and in the future, of and for the image(s) remain exclusively with Kimber Hodson.

There are no warranties, express or implied. The image(s) are provided ‘as is.’

Kimber Hodson shall not be held liable for any third party claims or incidental, consequential or other damages arising out of this license or Buyer’s use of the image(s).

Kimber Hodson reserves the right to use and publish Buyer’s images and photographs taken at the photography session to further promote its service, including portfolio, website, blog, and social media, unless otherwise discussed beforehand. Kimber Hodson agrees to limit the use of these images and photographs to promotional use only.
